Welcome to the Aussie Chook Supplies website. These Terms and Conditions apply to your use of our website and to any order you place with us.

By using our website, placing an order, or arranging a pick-up, you agree to these Terms and Conditions, our Privacy Policy, and any other policies referred to in these Terms.

If you do not agree with these Terms, please do not use our website.
 

1. About Us

Aussie Chook Supplies (ABN 46 542 774 497) sells poultry supplies and equipment through our website at www.aussiechooksupplies.com.au.

In these Terms, Aussie Chook Supplies, we, us and our means Aussie Chook Supplies. You and your means any person using our website or buying products from us.
 

2. Who can place an order

You must be at least 18 years old to place an order through our website.

By placing an order, you confirm that:

  • you are at least 18 years old;

  • the information you provide is accurate and complete; and

  • you are authorised to use the payment method you choose.
     

3. Using our website

We try to keep all information on our website accurate and up to date, but mistakes can sometimes happen.

You use the information on our website at your own risk. It is your responsibility to make sure that any products, services or information available through our website are suitable for your needs.

You must not misuse our website. This includes introducing malicious code, trying to gain unauthorised access, interfering with the operation of the website, or using the website for any unlawful purpose.

We may include links to other websites for your convenience. We are not responsible for the content, security or operation of any third-party website.
 

4. Product information and images

We do our best to show product colours, appearance, packaging and other details as accurately as possible.

However, actual products may vary from what appears on the website because of things like supplier packaging changes, product updates, reformulation, changes in size or weight, monitor settings, or computer equipment.

Unless we say otherwise, accessories or decorative items shown in product images are not included in the sale price.

Please read the product title and description carefully before placing an order.
 

5. Orders and when an order is accepted

All orders are subject to availability and our acceptance.

When you place an order, you are making an offer to buy the products from us. An order confirmation email, payment receipt, order number, or any automatic message from us only confirms that we have received your order. It does not mean we have accepted your order.

Your order is accepted only when:

  • we dispatch the products to you; or

  • we confirm that the products are ready for pick-up.

Until that time, we may need to cancel or change all or part of an order for reasons including stock problems, delivery issues, pricing mistakes, listing errors, technical problems, or suspected misuse of our website.

We may also limit sales to reasonable household quantities.
 

6. Availability of products

All products are offered subject to availability.

If we cannot supply all or part of your order, we will let you know as soon as reasonably possible. We may:

  • cancel the affected item or order and refund the amount paid for it;

  • offer you a similar item;

  • offer you a later dispatch date; or

  • give you the option to continue with the order on updated terms.

If a lower-priced replacement item is agreed, we will refund the difference using your original payment method.
 

7. Prices

All prices on our website are in Australian dollars.

Prices include GST where required by law, unless we clearly state otherwise. Delivery charges, customs duties and similar charges are separate unless stated otherwise.

We may change our prices at any time before you place an order.
 

8. Pricing errors and listing mistakes

We take reasonable care to make sure our prices, product descriptions, delivery charges, promotions and stock information are correct. However, mistakes can sometimes happen.

A price, discount, freight charge, promotion, product detail, stock level or other listing shown on our website may be wrong because of a typing mistake, human error, supplier error, technical issue, system glitch, data feed issue or other problem.

If we find an error before your order is dispatched or made ready for pick-up, we may:

  • correct the mistake;

  • contact you and give you the option to continue at the correct price or on the correct terms; or

  • cancel the affected item or the full order and refund any amount you have paid for the cancelled item or order.

If the price or promotion was clearly wrong, we are not required to supply the item at that incorrect price.

If we contact you about a pricing or listing error and do not hear back from you within the time stated in our message, or within 5 business days if no time is stated, we may cancel the affected item or order and refund any amount paid for it.

If a pricing error affects a product, we will correct the listing or withdraw the product from sale until the issue is fixed.

Nothing in this section limits any rights you have under Australian Consumer Law.
 

9. Promotions, discount codes and special offers

From time to time we may offer promotions, discount codes, free shipping offers, bundles or special pricing.

Unless we clearly state otherwise:

  • promotions are subject to availability;

  • promotions cannot be used together with other offers;

  • promotions may have their own conditions and expiry dates; and

  • we may correct, withdraw or cancel a promotion before dispatch or pick-up if it was published or applied in error.

If a discount code, free shipping offer or promotion is applied incorrectly because of a technical issue, system error or misuse, we may cancel or adjust the affected order before dispatch or pick-up.
 

10. Payment

Full payment for your order, excluding separately quoted freight charges for large or bulky items, will usually be taken when you complete your order.

For large or bulky items, delivery charges may be quoted separately. If you agree to those charges, they must be paid before your order is sent or released.

We currently accept payment methods listed on our website from time to time, which may include PayPal, Afterpay, Zip Pay, Stripe, Square and Direct Deposit.

We do not store your full credit card details.
 

11. Delivery address and PayPal address

You must enter the correct delivery address when placing your order.

If you pay using PayPal, it is your responsibility to make sure the delivery address you give us matches the address recorded with PayPal. If there is a difference, your parcel may be sent to the address linked to your PayPal account.

We are not responsible for loss caused by an incorrect address entered by you or by a mismatch between your order address and your PayPal address.

If goods are returned to us because an incorrect or alternative address was provided, you may need to pay further shipping costs before the goods are re-sent.
 

12. Dispatch and delivery timeframes

Most orders are posted within 1 to 3 business days after cleared payment is received.

Orders placed on weekends or public holidays are usually processed on the next business day.

Delivery timeframes depend on the delivery provider and are estimates only. We are not able to guarantee delivery dates once the parcel has been passed to the carrier.

To help get your order to you as efficiently as possible, we may choose the delivery company we believe is most suitable based on the goods, delivery risk, cost and timeframe.
 

13. Shipping within Australia

Orders, other than large or bulky items, are generally sent using Australia Post or Transdirect. Shipping charges are calculated at checkout unless stated otherwise.

Any customs, duties or similar charges are your responsibility.

If your order has not arrived within a reasonable time, you should contact us promptly using the contact details published on our website.
 

14. Authority to leave

If you are not home to receive your parcel, the carrier may:

  • leave the parcel if authority to leave applies; or

  • leave a card so you can collect the parcel from a post office, depot or other collection point.

We are not responsible for theft, damage or loss after a parcel has been delivered under authority to leave.
 

15. Delivery instructions and incorrect addresses

You may enter a delivery address that is different from your billing address.

You are responsible for the accuracy of any address details or delivery instructions you give us, including anything you place in an order notes field.

If a delivery issue arises, you may need to contact the carrier directly. If the parcel cannot be re-delivered, you may need to arrange collection at your own cost.

If a parcel was incorrectly delivered because of our error, we will work with you to fix the problem.

16. Returned parcels and abandoned parcels

A parcel may be returned to us if:

  • the delivery address was incorrect;

  • mail forwarding failed;

  • the parcel was not collected from a post office, depot or collection point; or

  • delivery could not be completed for another reason outside our control.

If a returned parcel needs to be sent again, we may ask you to pay the new delivery cost unless the return was caused by our error.

If a parcel is returned to us and you do not respond to our contact attempts or do not pay an agreed redelivery fee within a reasonable time, we may treat the parcel as abandoned.
 

17. Missing, stolen, incomplete or damaged orders

All Australia Post parcels include tracking details.

If your order is marked as delivered but you cannot find it, you should first check with neighbours, family members, reception, building management or your local post office.

If your parcel is still missing, please contact us as soon as possible and provide your order number, courier details and tracking number.

If a parcel appears to have been stolen after delivery, we may ask you to provide proof of delivery information and a police report before we decide whether a replacement will be sent.

If an item is lost or damaged while in transit and the issue was not caused by an incorrect address supplied by you, we will work with you on a suitable outcome.

If your order arrives incomplete or damaged, please keep the original packaging and send us photos so we can assess the problem quickly.

Nothing in this section limits your rights under Australian Consumer Law.
 

18. Pick-up orders

Pick-up is available for selected stocked items by appointment only.

Online ordering and payment are preferred before pick-up arrangements are made.

For pick-up enquiries, please contact us using the details published on our website.
 

19. Returns and exchanges

We want you to be happy with your purchase.

If you change your mind, we may offer a return, exchange, store credit or partial refund in line with this policy. Change-of-mind returns are not a right under Australian Consumer Law, so we may set conditions for accepting them.

For approved change-of-mind returns:

  • the product must be new and unused;

  • the product must be returned with packaging, tags and accessories intact where applicable;

  • return postage is your responsibility unless we agree otherwise; and

  • we may deduct a 15% administration and handling fee.

The same 15% fee may apply to approved returns for backorders, pre-orders or dropship items where we agree to accept the return.

Exchange requests should be made within 14 days of purchase unless we agree otherwise.
 

20. Faulty products and consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms removes or limits your rights under the Australian Consumer Law.

If a product has a major failure, you may be entitled to choose a refund or replacement, and you may also be entitled to compensation for other reasonably foreseeable loss or damage.

If a product does not have a major failure, we may choose to repair the product, replace it, or provide a refund, as permitted by law.

If you believe an item is faulty, please contact us as soon as possible with your order number, a description of the issue and photos if available. We may ask you to return the item so we can inspect it.

We will not direct you only to the manufacturer where the law says we, as the seller, must provide the remedy.
 

21. Refund processing

If we approve a refund, it will be returned using your original payment method unless we agree otherwise.

Please allow a reasonable time for us to assess the returned item and for the refund to appear in your account.
 

22. Products with special return conditions

Some products may have special return conditions because of their nature, packaging or ingredients.

For example, certain Peck Block products may not be eligible for refund if they have crumbled or broken apart unless they are returned in original sealed packaging and in saleable condition, except where your rights under Australian Consumer Law apply.
 

23. Brinsea warranty information

Certain Brinsea electrical products purchased from Aussie Chook Supplies may be covered by a 3-year manufacturer-related warranty period starting from the date the item is dispatched.

This warranty is subject to the conditions set by Aussie Chook Supplies and the manufacturer, including proof of purchase, serial number verification, and assessment of the fault.

This warranty applies in addition to your rights under Australian Consumer Law.
 

24. ChickenGuard warranty information

Certain ChickenGuard motors purchased from Aussie Chook Supplies may be covered by a 3-year manufacturer-related warranty period starting from the date the item is dispatched.

This warranty is subject to the conditions set by Aussie Chook Supplies and the manufacturer, including proof of purchase, proper use, and assessment of the fault.

If the product has been modified without approval, the warranty may be void.

This warranty applies in addition to your rights under Australian Consumer Law.
 

25. Pre-orders

We may offer selected products for pre-order from time to time.

If you buy an in-stock item together with a pre-order item, we may hold the full order until the pre-order item is available.

Any delivery date for a pre-order is an estimate only and is not guaranteed.

If there is a major delay or supply issue, we may contact you with updated options.
 

26. Limitation of liability

We do our best to keep our website, prices, promotions and ordering systems accurate and working properly, but mistakes and technical problems can sometimes happen.

To the extent permitted by law, Aussie Chook Supplies is not responsible for loss that results from website errors, pricing mistakes, promotion errors, stock errors, delivery delays, payment processing issues, technical failures, third-party platform outages, or other problems outside our reasonable control.

This includes loss of income, loss of business opportunity, loss of data or business interruption.

If we are found to be responsible to you in relation to an order despite these Terms, our liability is limited to the amount you paid for that order, unless the law says otherwise.

Nothing in this section excludes any rights that cannot legally be excluded under Australian Consumer Law.
 

27. Force majeure

We are not responsible for delay or failure to perform our obligations where the delay or failure is caused by events outside our reasonable control.

This may include natural disasters, fire, flood, pandemic events, war, civil unrest, labour disputes, supplier shortages, transport disruptions, border closures, utility failures, technology failures, cyber incidents or government action.

If this happens, we may delay delivery, update the supply arrangements, or cancel the affected order and provide a refund or credit as appropriate and as required by law.

We are committed to protecting your personal information.

Information collected through our website is handled in line with our Privacy Policy. We may collect information so we can process orders, respond to enquiries, improve our services and operate our website.
